SC now makes helmets mandatory for new two wheelers

Sounds harsh, but the ultimate decision has come. There is no way that the new wheeler owners will go on an excuse or rather continue complaining of wearing the head gear for various reasons ranging from losing hair, or excess develop of heat inside the helmet or sweating or simply because it is uncool.

The country's highest court, the Supreme Court of India has made it mandatory for all new two wheeler manufacturers to sell a helmet along with the motorbikes.



The Supreme Court has actually dismissed the plea made by the Society of Indian Automobile Manufacturers (SIAM) against such a rule which was brought in by Delhi High Court saying that the bike sellers should also provide a helmet by default to the buyers.

SIAM did not appreciate the rule and they have found a reason to object this too- they encountered problem to convince buyers who might be buying another bike or scooters as they well own a helmet from the previous bike.

SIAM also believed that the Delhi High Court ruling well conflict the Motor Vehicle Act of helmet for person by imposing helmet for bike.

SIAM lost their petition as well as the bike owners have no excuse whatsoever, as they will have to buy a helmet along with their respective bikes, which will of course cost them a few more hundred rupees. Nevertheless there will be fewer deaths due to head injuries and so let us cheer that the resolution will save in heads and their lives of bikers.

The SC bench comprised of Justice G S Singhvi & Justice A K Ganguly dismissed the petition filed by SIAM challenging the previous order issued by the Delhi High Court. The apex court also stipulated that the bikes manufacturers have to sell BSI certified helmets. In June 30th 2009 the High Court had made it a stringent rule that all dealers need to sell helmets with the new two wheelers and if they failed to do so the vehicles were not be registered. SIAM had argued that the High Court is not giving the customers the freedom to select a helmet of their choice.

The rule has come into force just a couple of days before and there is already overwhelming criticism about the new rule- that there should be strict enforcement on helmet wearing rather than mere helmet buying; sounds lot of sense.
