The Apex Court on Wednesday has given a green signal for the two-wheeler company TVS motors to go ahead with the manufacture and sale of Flame 125cc. TVS Motors was dragged to court by their rivals Bajaj Auto who claimed the latter to have used their patented twin spark technology for their brand TVS Flame and so the legal battle. The court’s decision has helped TVS Motors to take a big U-turn and considering the fact that the company holds the position of being third largest two-wheeler manufacturer of the country this new lease of life for Flame will make a huge difference to the company in terms of sales.
The relieved CMD of the company Venu Srinivasan has told that the court’s decision has justified the company’s stand and now they will proceed with the manufacturing of Flame bike with twin-spark technology and also the decision will be taken as to when they would begin the marketing of the bike with new technology. Srinivasan also stated that in spite of manufacturing the product previously they lost more than a year in the litigation process.
The court has also directed TVS Motors to keep an account of the sales of the TVS Flame 125cc and it has asked the Madras High Court to review the matter by 30th November. The receiver appointed by Madras High Court will keep a check on the account sales of Flame bikes with the twin-spark technology. This procedure will help the court to decide on the damage that will have to be paid to Bajaj in case if the Madras High Court gives a verdict favouring Bajaj motors after the trials.
Bajaj on the other is at the receiving end; the company has so far spent more than eight crores in the promotion of DTSi technology but the legal source from Bajaj have revealed that the company might drag the issue to Intellectual Appellate Board and if the matter is resolved here it will be considered as one of the quickest trials in the history of Indian judiciary.
Some of the Industry trackers though feel that Bajaj have been greatly successful in promoting their DTSi technology and that TVS with this technology will be considered as a mere follower.
As of now TVS Motors is largely focusing on increasing of the sales of its 125cc brand TVS Flame 125cc with single spark plug and there are still apprehensions about the court appointed receiver handling the sales.
Many technologists feel that this technology has not had a great impact on the Indian consumers at least. Only time will tell how TVS will promote its new series of the Flame 125cc with the twin-spark plugs.
